While the number of mother’s being named Primary Residential Parent is significantly higher than that of men; the courts are strongly upholding the rights of fathers to take an active and consistent role in the daily lives of their children. In addition, there has been an increasing trend for courts to award custody and/or primary residential status to the parent most willing to work with the other parent to co-parent the children.
Case Samples:
A. Husband initiates divorce proceedings. Mother states he will never see 18 month-old baby again. Mother flees to another state with child. Father hires private detective to track down child. Court orders child returned to the state. With no previous history or evidence of Domestic Violence on record, Mother alleges domestic violence on part of the husband. In stern language Judge awards custody to father with Supervised Visitation through an Agency for the mother.
B. Unmarried couple; mother and father are awarded joint custody. Mother is primary residential parent. Mother states that father does not pay child support and is therefore unfit as a father and refuses father visitation. Court orders visitation for the father explaining that failure to pay child support is not grounds to suspend visitation. Mother refuses visitation, claims father has a history of illegal activity and has questionable affiliations, however is unable to prove that father has ever acted inappropriately in the presence of the child. Court orders Supervised Visitation for the father. Father’s vehicle is mysteriously towed away during supervised visitation. Mother files for injunction claiming father accosted her in the middle of a Church service. With no credible supporting witnesses Court dismisses injunction however orders parties to stay away from each other and have monitored custody exchanges. Mother frequently cancels visitation claiming son is ill. Father alleges parental alienation, the Court awards father custody of the child. Mother is now required to attend “Supervised Visitation”.
