If the Moslems are lured to fight during the sacred months, they should have not started the fight; but if the enemy is attacking first then they may forget the sacred months and go to fight. And when the sacred months passed, then kill the polytheists whenever you find them, and capture them and besiege them and keep them under surveillance. But if they repent and perform the prayer and pay the obligatory charity then leave them free. Allah is Most Forgiver Most Merciful (9:5).
This verse is also alerting the Moslems about the possibility of attack from the disbeliever taking the advantages from the idle situation during the sacred months, that is the meaning of ‘keep them under surveillance’.
Treat the POW accordingly, no torture allowed, Allah promised a big reward in the Hereafter. The main objective of war is to restore the order after the chaos. The fight is obligatory against the attacking disbelievers, but as they surrender or cease then the fight has to be terminated, and the prisoner of wars (POW) have to be treated acoordingly with food, medication and shelter. The special attention was awarded to the POW, Mohammad was ordered to take care of them and maintain their rights; this is the ethics of war in Islam. Allah grants the big reward for the Moslems who take care of the POW: "And (the pious Moslems tell their story why Allah granted them to enter the Paradise because) they provided the food with love to the poor, orphan and prisoner of war. The said: ‘We give you the food in the course of Allah, we never expect your reward nor thankfulness’. ‘Verily, we only fear from our Lord in the Day of Judgement where the people come with the horrible face and full with unresolved burden’" (76:8-10). It is clear from this verse that the main objective of the war is not to kill the enemy as much as possible, otherwise the killing of POW is recommended and not necessary to take care of them. The main idea of the good treatment to the POW is to provide them a real example what the Islam is. Grant the asylum for non-Moslem regardless of whether he/she will be embracing Islam or not. And if anyone of the polytheists seeks you protection then grant him the asylum so he can hear the truth of Allah’s verse and then escort him to the place he can be secure, that is because they are the fool people (9:6). This verse 6 of Surah At-Taobah is a guarantee of safety and security for anyone who seeks the asylum from the Moslems without considering his/her future faith; the main idea is the disbeliever will soon hear the truth of Allah’s verse. The attacking disbelievers are not understanding the divine truth otherwise they will not attack the Moslems, therefore if they are asking the refuge then grant the safety for them even without their promise to embrace Islam in the future. To embrace Islam is the guidance from Allah, it is His decision to enlighten their hearts.
