About the Book

Anyone studying the law, contemplating civil litigation, already involved in litigation, and who does not desire an attorney or who cannot afford an attorney needs to get a copy of this book. This book provides knowledge of legal terms, frivolous litigation, federal constitutional rights, how to read and speak cited cases to a court, and details the numerous types of lawsuits in civil litigation from simple small claims torts all the way to medical malpractice complaints. This book will give any person knowledge of their First, Eighth, and Fourteenth Amendment rights, what different types of lawsuits there are in Indiana, how to properly exhaust remedies before filing a lawsuit, how to file a lawsuit, how to obtain evidence to support any case, how to access and request public records, how to dismiss a case filed against them, and how to appeal any decision against them in the Indiana Court of Appeals. This book comes with 86 legal documents that will help guide any person contemplating, or already in court defending or prosecuting, any lawsuit in the State of Indiana. A lot of these legal documents can also be used in other civil cases aside from lawsuits. No matter what stage in litigation you are at, this book will help guide you to the relief you seek in court.

About the Author

Eric D. Smith has over twelve years of pro se experience in the federal and state courts, having won numerous decisions in his favor by the federal and state court of appeals and having obtained three pretrial settlements in three separate civil cases. In 2008, he was able to get an Indiana State law found unconstitutional by the Supreme Court of Indiana. See: Smith v. Indiana Department of Correction, 883 N.E. 2d 802 (Ind. 2008). Mr. Smith is a US Army veteran with an honorable discharge and is a prisoners’ rights advocate. In addition to this book, Mr. Smith has helped prepare documents for numerous people related to their issues in court (See for example: Ashby v. State, case no. 20A03-0808-CR- 471 (Ind. Ct. App. April 17, 2009) (helping Ashby prepare the documents that freed him for prison after being illegally sentenced)), and has written two zines, published by the ABC South Chicago Zine Distribution entitled “Anarchism and Litigation” and “The Handbook for the Wrongfully Convicted: What do you do when the judicial system fails you and gives you the shaft?” In addition, Mr. Smith is the owner of the Self Help Legal Aid Company, LLC, that provides legal knowledge and legal forms for all legal matters here in Indiana, including bankruptcy packages for the federal courts. Mr. Smith studies Legal Studies through Adams State University’s distance degree online program, and will then attend law school so he can one day become an attorney and practice law in the State of Indiana. Mr. Smith preaches that with the right preparation and legal forms, anyone can successfully represent their self in court and win their cases just like he has without having to spend costly money on an attorney who may be ineffective.
