Alena just saved my life. Judge would give me at least 12 years. My guarding angel was with me, standing there with his hands open. That is the only think I was sure about. But Judge was not about to give up. Rape was out, but there was still sexual abuse of minor on the line: “Did defendant ask you how old you were, and did you tell him, that you were underage?” Another tricky, illegal question and answer is just in it? Exactly what Demjan was doing. In Slovak law book, is written very clear, that you do not ask witness question, in which the answer is outlined. But this court was jus as far from justice as it is potentially possible. All she needs to say yes. All of them were trained to say yes. It was written 25 times in investigative file, by Demjan. They were all prepared thoroughly, just to say yes to this one crucial question. And Judge just asked it. Would anybody expect her to say no, when she was well trained to say yes. I knew this is it. I’m finish, I’m done. The answer was like a blast to my ears that I do not believe it until today: “No, defendant never asked me how many years I had and I never told him how old I was.” - that was Alena‘s Shock # 3 Judge, and prosecutor Sabo were stunned, and I was stunned even more. What is going on, - I thought, - after mountains of lies, I’ve heard today, the woman is telling the truth. Something is wrong here. But judge is in charge and to him, she is just stupid little girl. She must say what she is required: “But your sister Anna said that she was there, when defendant asked you how old you were and she heard you telling him, that you were 14.” This should remind a little bitch - judge said to himself - what she should say. If she says yes, they will write, that she forgot it and now she remember that I asked her and she told me. That way they will have me where they want me. But another surprise: Alena‘s Shock # 4- “No, it was when we were going away, my sister asked me, if defendant asked me how old I was and I told her that he never asked me and that I never told him.” I was very surprised and it looked that there was nothing that can be used against me. From this should have been clear that I didn’t rape her, I didn’t insist in any way, and I had no idea, how old she was; therefore I committed no crime. But Judge is using another trick: “How did you know, that all this took place at the beginning of 1995, as it was written in your statement?” Judge kept on asking. If she had some reasonable explanation, that she knew it by some point, there still could be some case against me. Again it was a question, with answer right in it. What could I do? Could I yell objection to judge, that is going to sue me? Could I sue Judge for breaking the law? Could I at least kick his face? Not likely. All I could do was waiting for the answer, hoping for the best, and see what he is going to try next: Alena’s shock # 5 “I have no idea what is in my questioning statement, because nobody read it to me, and I don’t know how to read, I only know how to write.” - Again quiet laugh was heard in court. It was another honest answer and life saver for me. You would expect that this was enough.
